Kurdoff Rentals Section: Terms of Use

1. What this section is and who we are

The "Rentals" section at kurdoff.com/rent is a directory and comparison service for car rental companies, operated by Barmaan Trading Company (BTC) of Erbil, Kurdistan Region of Iraq ("Kurdoff", "we"). We display rental companies' listings, let you compare them, and pass your contact or booking request to the company you choose. That is all we do.

By using this section you accept these Terms. If you do not accept them, please do not use this section. You must be at least 18 years old to use it.

2. Our role: an introduction intermediary only

• Kurdoff is not a party to any rental contract. The rental contract is formed directly and exclusively between you and the rental company.
• Kurdoff is not your agent and not the rental company's agent; we are not a brokerage, broker, lessor, or transport service provider.
• Kurdoff is not an insurer and does not provide or guarantee any insurance cover — for the vehicle, the driver, passengers, or third parties. Any insurance that exists belongs to the rental company and is governed by that company's own policy terms.
• No payments pass through Kurdoff. All payments (rental fees, deposits, fines, damages) are made directly between you and the rental company. We collect no money from you and are not responsible for any payment, refund, or financial dispute between you and the company.

3. Responsibility of the rental companies

• The content of each listing (vehicle specifications, photos, prices, conditions, availability) is provided by the rental company, and full responsibility for its accuracy lies with that company.
• The quality, safety, and technical condition of the vehicle, timely handover, and performance of any contractual obligation rest entirely with the rental company.
• We aim to list only companies that have presented themselves as licensed car rental businesses and have provided documents (Section 4), but your legal relationship is with the company only, not with us.

4. The "documents reviewed" badge — what it actually means

Some companies carry a badge reading "documents reviewed on [date]". This badge means only that on that date, documents (such as a business licence and fleet insurance certificate) were presented to us and we sighted them as documents.

The badge is not a guarantee of the authenticity or legal validity of those documents; it is not a guarantee that the licence or insurance remains valid after that date; and it is not a guarantee of, or recommendation about, service quality, vehicle condition, or the company's future conduct.

Before signing any contract, check the company's documents, insurance policy, and conditions yourself.

5. Prices

• All prices are set and published by the rental companies. Displayed prices — including "from X dinars" prices — are indicative and non-binding, and are not an offer to sell by Kurdoff. The final price is whatever you agree directly with the company.
• Our transparency commitment: we ask companies to state in each listing the all-inclusive price (including mandatory charges), the deposit amount, and the insurance excess. If a listing shows this information incompletely or misleadingly, please report it so we can follow up; responsibility for the accuracy of this information nonetheless remains with the publishing company.
• Featured or promoted placements in results are labelled as such.

6. Booking requests and leads — not a confirmed booking

• The "call" and "WhatsApp" buttons and the "booking request" form only provide a way for you to reach the company. Submitting a request does not create a confirmed booking and creates no obligation for the company or for us.
• Booking confirmation, contract formation, vehicle handover, and payment all happen directly between you and the company.
• We do not guarantee a response, response time, or vehicle availability.

7. Rental eligibility conditions

Minimum driver age, driving licence and required documents, deposit, mileage limits, and any other rental condition are set by each company individually and may differ between companies. Verifying your eligibility is the company's job; we play no part in it.

8. Damage, accidents, and disputes

Any damage claim, accident, fine, or dispute arising from a rental is a matter between you and the rental company and must be pursued directly with that company (and, where necessary, through legal channels). Kurdoff operates no compensation scheme, arbitration, or binding mediation; however, we do receive reports about bad experiences and may suspend or end our cooperation with a company on that basis (without being obliged to do so).

9. Your personal data in the request form

When you submit a booking request form or click the call/WhatsApp button, we forward details such as your name, phone number, rental dates, and message to the company you selected — that is exactly what the service does, and by submitting the form you consent to it. That company's use of your data is governed by its own practices and is outside our control. We keep a copy of the request for support and service statistics. 10. Service provided "as is"

This section of the site is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, nor the completeness or currency of information (including vehicle availability and prices).

11. Limitation of liability

To the fullest extent permitted by law, Kurdoff is not liable for any direct or indirect loss arising from the rental contract, the condition of the vehicle, the conduct of the rental company, or your reliance on listing information.

12. Indemnification by the user

You agree to indemnify Kurdoff against damages and reasonable defence costs if a third party brings a claim against us caused by your breach of these Terms or your misuse of the service.

13. Changes to these Terms

We may update these Terms. The current version is always published on this page with a "last updated" date, and your continued use means acceptance of the new version.

14. Governing law and dispute resolution

These Terms are governed by the laws in force at our place of registration in the Kurdistan Region of Iraq, and disputes arising from them are subject to the competent legal authorities there.

15. Languages

These Terms are published in four languages (Persian, Sorani Kurdish, Arabic, and English). All versions are intended to carry the same meaning and, in case of doubt, are read consistently with one another.
